Alternative Dispute Resolution
Paul Tichauer provides a full range of alternative dispute resolution (ADR) services—mediation, arbitration and dispute boards—grounded in decades of executive leadership, technical expertise, and international ADR experience. Mediation
Mediation provides a structured environment for parties to reach mutually acceptable solutions while preserving valuable relationships. Drawing on his background as a corporate leader and trained mediator, Paul facilitates constructive dialogue that helps participants clarify interests, explore options, and achieve sustainable settlements—often without the delay or cost of more formal proceedings.
Paul’s extensive experience as a senior executive, as a corporate board member as well as a director and board chair in the not-for-profit sector has demanded his direct intervention in a huge variety of disputes requiring mediation: commercial disputes between supplier and customer; internal disputes between management and the Board; HR disputes between employee and supervisor; personal disputes between employee and the company; individual disputes surrounding promotions, demotions, and terminations; and especially the renegotiation of multi-year labour agreements between unions and the company. All of these situations have helped shape Paul’s dispute resolution style, effectiveness and facility.
Arbitration
Arbitration offers a binding and enforceable means of resolving complex commercial and technical disputes.
Paul serves as an independent and impartial arbitrator, combining executive insight with rigorous procedural discipline. His approach ensures that hearings are conducted efficiently and in confidence; decisions are well-reasoned; and the parties experience a fair and transparent process consistent with international best practice.
Paul’s arbitration experience includes serving on multiple three-person panels as well as a sole arbitrator. His arbitrations include a complex multi-party dispute requiring extensive use of experts to clarify and prioritize the multiplicity of factors influencing the core issue in dispute and his award was accepted by all parties. Paul understands the importance of consistently applying arbitration rules and of serving in an independent and impartial manner. He was invited to be a member of the 2024 IBA Task force revising its guidelines on conflicts of interest and is a multi-year member of the ICC Commission on Arbitration and ADR.
Dispute Boards
Dispute boards support effective contract performance and early issue resolution, particularly in large infrastructure and industrial projects. As a dispute board member or chair, Paul works proactively with project participants to identify potential conflicts, promote collaborative problem-solving, and maintain project continuity. His balanced, evidence-based approach contributes to timely and equitable resolutions that uphold both contractual integrity and project success.
